1. Introduction
Motoglobe.hu Korlátolt Felelősségű Társaság (registered seat: 1064 Budapest, Podmaniczky utca 57, 2/14; company registry no.: 01-09-208894; hereinafter: motoglobe.eu, service provider, or data controller), as data controller, hereby accepts the provisions of this statement as binding upon itself, and undertakes an obligation to ensure that its data controlling activities related to its services provided comply with the requirements of this policy and the relevant provisions of law in effect.
The data protection guidelines related to the online portal accessible at www.motoglobe.eu and www.motoglobe.hu shall be available continuously at http://motoglobe.eu/privacy-policy and http://motoglobe.eu/login/privacy-policy .
Motoglobe.hu Kft. reserves the right to change this data protection statement at any time, with notification given to its users in due time.

In the following, motoglobe.hu Kft. presents its principles of data controlling and the requirements formulated and undertaken to be bound by motoglobe.hu Kft. as data controller. These principles of data controlling are in harmony with the relevant provisions of law on data protection, as in effect, including in particular:
2. Definitions
2.1. Personal data shall mean any information relating to the data subject, in particular by reference to their name, an identification number or to one or more factors specific to their physical, physiological, mental, economic, cultural or social identity, and any reference drawn from such information pertaining to the data subject.
2.2. Consent shall mean any freely and expressly given specific and informed indication of the will of the data subject by which they signify their agreement to personal data relating to them being controlled fully or to the extent of specific operations.
2.3. Objection shall mean a declaration made by the data subject objecting to the controlling of their personal data and requesting the termination of data controlling, as well as the deletion of the data controlled.
2.4. Data controller shall mean the natural or legal person, or organisation without legal personality, which alone or jointly with others determines the purposes of the processing of data, makes decisions regarding data processing (including its means), and implements such decisions itself or engages a data processor to execute them.
2.5. Data processing shall mean any operation or sum of operations performed on the data, irrespective of the method used, including, for example, the collection, entering, recording, organizing, storage, changing, using, transmission, disclosure, harmonising or linking, blocking, deletion and destruction, as well as the prevention of the further use of the data. Data controlling shall also include the taking of photos, making audio or visual recordings, as well as registering physical characteristics suitable for personal identification (such as fingerprints or palm prints, DNA samples, iris scans, etc.).
2.6. Data transmission shall mean making the data accessible to certain third parties.
2.7. Disclosure shall mean making the data accessible to anyone.
2.8. Deletion shall mean making data unrecognisable in a way that it can never again be restored.
2.9. Blocking of data shall mean marking data with a special ID tag to restrict its further processing indefinitely or for a definite term.
2.10. Data destruction shall mean the complete physical destruction of the data or the medium on which the data is stored.
2.11. Data processing shall mean the technical operations involved in data control, irrespective of the method and instruments employed for such operations and the venue where it takes place, provided that such technical operations are carried out on the data.
2.12. Data processor shall mean any natural or legal person, or organisation without legal personality, that processes personal data on the grounds of a contract, including contracts concluded pursuant to legislative provisions.
2.13. Third party shall mean any natural or legal person, or organisation without legal personality, other than the data subject, the data controller or the data processor.
2.14. Third country shall mean any State that is not a member of the European Economic Area.
3. Principles of data controlling by motoglobe.eu
Personal data may be controlled when:
a) the consent of the data subject is obtained, or
b) ordered on the basis of authorization provided by the law or – in the scope specified in such authorization – by a decree of a local government.
In case of a person lacking legal capacity or having a restricted legal capacity, the consent of the legal representative (guardian) of such a person is not required, since the statement is aimed at registration occurring in large numbers in everyday life, and it does not require any particular consideration.
Personal data may only be controlled for a specific purpose, in the interest of the exercise of a right or the performance of an obligation. The data controlling activity shall be in line with this purpose at all times.
Only such personal data may be controlled that is indispensable and suitable for achieving the purpose of the data controlling, and only to the extent and for the duration of time necessary for achieving that purpose.
Personal data may only be controlled on the basis of informed consent.
It is necessary to inform the data subject unambiguously, in an easily comprehensible way, and in sufficient detail concerning all facts related to the data controlling, including in particular the purpose and the legal grounds for the data controlling, the person authorized to control and process the data, the duration of the data controlling, and who may have access to the data. The information provided shall also cover the rights of the data subject related to the data controlling and the possibilities of legal remedy.
The personal data processed shall be:
a) recorded and controlled fairly and lawfully;
b) accurate, complete and, if necessary, up-to-date;
c) stored in such a way that the data subject can only be identified as long as necessary for the purpose of storing the data.
The use of a general and uniform personal identification code, which is suitable for use without limitation, is prohibited.
Personal data may be transmitted and the various data control activities can be connected if the data subject consents, or the law permits, and the conditions of data control are fulfilled for each piece of personal data.
Personal data (including special data) may be transmitted from the country – independently from the medium or the mode of data transmission – to a data controller or data processor located in a third country only if the data subject consents or the law permits, and provided that the protection of personal data at the proper level is ensured in the third country in the course of the controlling and/or processing of the data transmitted. Any data transmission to member states of the European Economic Area shall be regarded as if such data was transmitted within the territory of the Republic of Hungary.
4. The scope of the personal data, the purpose, the legal grounds and the duration of the data controlling
Within the services, the controlling of all personal data shall take place on the basis of voluntary consent.
4.1. The data of visitors to the website
During the course of visiting its websites, motoglobe.hu Kft. records the date and time of the visit, as well as the address of the webpage visited, for technical reasons, and for the purpose of making statistics related to the users’ habits.
The data are stored on the server until the use of statistics.
For the purpose of providing personalized services, the service provider places a small data package called a “cookie” on the user’s computer. This allows the system to display special offers belonging to the category you visited.
Users are able to delete cookies from their own computers, or set up their browser in such a way that the use of cookies is not allowed.
4.2. Data links to external service providers on the website
The html code of the www.motoglobe.eu website may also contain links independent from motoglobe.hu Kft., received from or pointing to external servers.
One of these external servers helps with the independent auditing of the visiting and other web analytical data of the website (Google Analytics). The other external server is used for the purpose of displaying advertisements on the website. The data controllers can provide more information on the controlling of such data.
4.3. Registration database
The services of motoglobe.eu are subject to registration. Activity permitted on the portal without registration is limited.
The data in the registration database controlled by the service provider include the user name and the password, the e-mail address, the date of the registration, the IP address at the time of registration, the data and images of the motorcycle(s) owned by the user, as well as the location (settlement), gender, and date of birth entered by the user. These data are indispensable for identifying the users, maintaining contact with them, and for invoicing.
In addition to the above, the database also contains information on whether the user requested a newsletter or not, and if so, whether in html or text format. The data controlling related to the newsletter is dealt with in a separate section.
Most of the data can be changed on the website. Users may also delete the data themselves, or request the deletion of the data in the Contact menu item.
4.4. Data control related to the routes uploaded
At the time when routes prepared by users are uploaded, the user may decide whether those routes may be seen, downloaded and shared with other users by
a) all users visiting to and using the motoglobe.eu website,
b) only the group of users specified by the user who uploaded the routes, or
c) only the user who uploaded the routes.
The user uploading routes shall not, after the uploading, have ownership title to the routes uploaded, or have any claims for intellectual property related to the same. The routes uploaded may be freely used by motoglobe.eu and/or the users of motoglobe.eu, within the group of users specified by the uploading user (Section 4.4, a-c).
The operators of motoglobe.eu may – also without providing reasons – delete or remove from the website any route uploaded by a user.
The data of the uploaded routes may be saved for an unlimited period of time subject to the decision of the data controller.
4.5. Newsletter and other notifications
With the function of the route tracking function, the user can request periodic notification of recently uploaded routes that meet the criteria specified by the user.
A service provider shall send newsletters on novelties to users who requested the sending of the newsletters. The content of the newsletters sent may be different on the basis of the data entered by users.
In addition to the above, the system of the service provider may occasionally also send other messages, inherent with the service itself.
4.6. Recommending a route to a friend, inviting a friend
If the user finds a particular route or any service of motoglobe.eu to be of interest, the system also provides an opportunity for users to send notifications to their friends, in the their own name and using their own e-mail address.
The system does not record the data of the addressee and the content of the message.
4.7. Images, notes
At the time when routes prepared by users are uploaded, the user may also enclose pictures and notes with the route uploaded. Users may also add images and additional text to their own profile and shared content. After uploading, the user may decide whether such content may be seen, downloaded and shared with other users by
a) all users visiting to and using the motoglobe.eu website,
b) only the group of users specified by the user who uploaded the content, or
c) only the user who uploaded the content.
The user uploading the images and text shall not, after the uploading, have ownership title to the routes uploaded, or have any claims for intellectual property related to the same. The content uploaded may be freely used by motoglobe.eu and/or the users of motoglobe.eu, within the group of users specified by the uploading user (Section 4.7, a-c).
The operators of motoglobe.eu may – also without providing reasons – delete or remove from the website any content uploaded by a user.
The uploaded content may be saved for an unlimited period of time subject to the decision of the data controller.
4.8. Contacting the service provider
The service provider may be contacted using the form on the website, by way of providing the user’s name, e-mail address and the message to be sent, or directly by e-mail. The messages shall only be used by the service provider for their intended purpose, and shall be archived after the matter at hand is settled definitely.
4.9. Other data controlling activities
We provide information on other data controlling activities not listed here at the time when such data is recorded.
We hereby inform the users that courts, the prosecutors’ office, or the investigating authority may request the service provider to provide information, to disclose or hand over data or documents (Section 71 of Act XIX of 1998).
In such cases, motoglobe.hu Kft. shall only provide or disclose such personal data and to the extent that is indispensable for achieving the purpose of such requests, provided that the authority identified the exact purpose and the scope of data requested.
5. The storage of personal data, the security of the data controlling
The servers from which the websites of motoglobe.hu Kft. are served are operated by Rendesweb Kft., and are located at the address 1173 Budapest, Határhalom utca 4.
Motoglobe.hu Kft. shall chose and operate the information technology equipment used in the course of the provision of the service in such a way that:
a) the data controlled shall be accessible to authorised parties (availability);
b) their authenticity and certified status can be ensured (authenticity of data controlling);
c) the data can be proved to be unchanged (data integrity); and
d) the data shall be protected against unauthorised access (confidentiality).
Motoglobe.hu Kft. shall use such technical, organisational and institutional measures to ensure the security of the data controlling that provides a suitable level of protection against the risks arising in connection with the data controlling.
In the course of the data controlling, motoglobe.hu Kft. shall ensure:
a) confidentiality: protecting the information so that only authorised parties can have access to them;
b) integrity: protecting the accuracy and completeness of the information and the method of processing;
c) availability: ensuring that when an authorised user needs the information, they can in fact have access to it, and the equipment related to this are available for use.
The information technology system and network of motoglobe.hu Kft. are protected against computer-based fraud, espionage, sabotage, vandalism, fire and flooding, as well as computer viruses, computer hacking and denial of service attacks. The operator ensures security by way of server-level and application-level security procedures.
We inform the users that, independently from the protocol used (e-mail, web, ftp, etc.), electronic messages transmitted over the internet are vulnerable against network threats that lead to unfair activities, the challenging of contracts, or the disclosure or modification of information. The service provider shall take all reasonable precautions to protect users from such threats, and shall monitor the systems in the interest of recording any security discrepancy, as well as to provide evidence in case of any security event. In addition, the system monitoring also allows makes it possible to check the efficiency of the precautions used.
The data controller shall control the user’s data during the time of the registration, and shall delete the same after the registration is deleted.
The user’s data may be available to the data controller.

7. Legal remedies
Data subjects may request information on the controlling of their personal data, and may request the correction or – with the exception of cases of data controlling specified by the relevant provision of law – the deletion of their personal data in the manner indicated at the time of registration, or by way of the customer service.
At the request of the data subject, motoglobe.hu Kft. as the data controller shall provide information on the data subject’s data controlled by it and/or processed by the data processor commissioned by it, the purpose, the legal basis and the duration of the data controlling, the name and address (registered seat) of the data processor, its activities related to the data controlling, as well as on who and for what purpose have received or will receive the data. The data controller shall be required to provide the information as soon as possible after the request is submitted, but in any case not later than 30 days, in writing, in an easily comprehensible way.
Motoglobe.hu Kft. shall delete the personal data if the controlling of the data is unlawful, if deletion of the personal data was requested by the data subject, if the purpose of the data controlling ceased to exist or the statutory deadline for the storing of the data expired, or on the basis of the order of the court or the data protection ombudsman.
Notice of the correction or deletion shall be sent by motoglobe.hu Kft. to the data subject, as well as to all parties to whom the data has been transmitted. The notification may be dispensed with if this does not violate the rightful interest of the data subject.
Data subjects may object to the controlling of their personal data if
a) the controlling (transmission) of the personal data is necessary for the performance of a legal obligation applicable only to the data controller, or for the enforcement of the rightful interests of the data controller, the receiver, or a third party, unless the data handling was required by law;
b) the use or transmission of the personal data is for the purpose of direct generation of business, public opinion polling or academic research; or
c) the exercise of the right of objection is otherwise made possible by law.
Simultaneously with the suspension of its data controlling activity, motoglobe.hu Kft. shall examine the objection as soon as practicable, but in any case within 15 days after the request was submitted, and shall inform the person submitting the request about the results of its findings in writing. If the objection was well-grounded, the data controller shall terminate the data controlling activity – including the further recording and transmission of data –, block the data, and give notice of the objection and the measures taken on the basis of it to all parties to whom the personal data concerned by the objection was previously transmitted, which parties shall be required to take the necessary steps to enforce the right of objection.
If the data subject disagrees with the decision of the data controller, they are entitled to turn to the court within 30 days from the communication thereof.
Motoglobe.hu Kft. may not delete the data of the data subject if the data controlling activity was required by law. However, the data may not be transmitted to the data receiver if the data controller agreed with the objection, or the court found that the objection was well-grounded.
Data subjects may take legal action against the data controller in case their rights are violated. The court shall act in such cases in expedited proceedings.
Motoglobe.hu Kft. shall be liable for any damage caused by way of any illegal controlling of a data subject’s data or the breach of the requirements of technical data protection. The data controller shall be exempt from liability if the damage was caused by a reason outside the scope of the data control.
No compensation for any damage shall be paid to the extent that it was caused by the wilful or grossly negligent conduct of the injured party.
